Empuriabrava: “The sea on your doorstep”.

The originality of Empuriabrava is in the structure of the development: Typical for the cityscape Is the grid-shaped net off driveable channelsthat stretches through the whole city over a total of over 30 kilometers. Most houses have one Private access to the water. You can dock right on your doorstep by boat.

Ape (Asociación de Propietarios de Empuriabrava) has just announced that, after 6 years of uncertainty, Sales of boat seats can be entered in the land register again!

Coastal Law of 1988
This is the result of the difficult work and all the efforts of the APE. Thanks also go to the notary of Castello d’Empuries and the head of the land registry in Roses, who made this solution possible.

The APE was founded in 2008 to counter the application of the Deslinde – to protest the 1988 Coastal Law. On the basis of this law, the delimitation of the coastal strip (Deslinde) as state property should also be used on the banks of the canals in Empuriabrava and Santa Magarida. The Spanish Coastal Act states: The so-called Dominio publico Maritimo Terrestre Estatal (state property on the coastal strip) is primarily private property.

If the APE had not mobilized and informed all owners at the time, the Deslinde would have been pulled through in September/October 2008 without an objection and all deadlines for objections had passed. The APE has ensured the information of all owners and lodged objections on their behalf in due time.

with the deslinde and the application of the 1988 Coastal Law In 2008, all purchased boat seats and flooded land were state property (Dominio Público) in one fell swoop. The canal walls were declared a coast. As a result, a 6 m wide strip was stipulated on the private properties along the water as public access to the coast. This strip had to be free from any development or planting.

This was even taken over in the Neue Poum, the municipality’s development plan.
In the land register, an addition was noted for each property that the Coastal Act of 1988 applies (6 m strips plus boat places = state ownership).
property on the canal Had lost a lot of value as a result!
The transfer of ownership of boat seats in the land register was also no longer possible!

The APE made a great effort for the government in Madrid in May 2013 in the new Coastal Act 02/2013 an addition to the law for Empuriabrava and Sta. Margarita recorded, which is based on the text submitted by the APE with the lawyers:
anchored in the new coast law
- 1. There are no new strips along the canals.
- 2. The owners of land on the canals have the right to create boats along the property and this right is not separable from the property!
- 3. The owners of their own boat berth, which was entered in the land register, get back full ownership.

A fantastic success of the Ape, from which everyone in Empuriabrava benefits!
Since May 2013, the APE has been fighting for the new law to be applied by the land register. Although the notaries have created notarial documents according to the new law, the land register has still refused for the last 3 years Boatplace Sales to enter.
The reason was that a new Deslinde would have to be made in Empuriabrava first.
This big goal was also achieved on May 5th, 2016!

The APE will continue to defend the interests of the owners in the future!
Your interests are also protected for a membership fee of only 50 € per year!
